TERMS OF USE
The following is a list of examples of what a group program may include:
1. Portal Access. You receive access to the training on the start state of your program. This includes written materials, video, audio lessons, quizzes, surveys on course topics.
2. 1:1 and Group coaching sessions. You are invited to weekly coaching sessions for the during of the program, to be conducted virtually (via Skype, Zoom, or appropriate means). Your attendance is critical for the success of this program and there are limited times available. Therefore, please make your best efforts to make our available days work. You will receive a scheduling link once your payment is received. The purpose of the coaching session is to coach you on the weekly course module learning outcomes and scenarios and guide to through your transformation. For group coaching, if you miss a session a copy will be maintained on the platform for your viewing.
3. Community Forum Support. The group forum is housed within this training platform. You will have access where you can submit questions, files, and other materials for the group to critique. You will participate in the group through the of the course with occasional live streams, question and answer sessions, and other information as the group needs dictate. We will also hold “hot seats” or to hear from the members on their progress.
SCHEDULING POLICIES
To schedule coaching sessions, we will send you a list of our available days and times. There is no guarantee that our availability will match yours.
CONFIDENTIALITY
Confidentiality. Life with Jan (a brand of StrategyNook LLC) cannot guarantee confidentiality. Do not share any confidential and proprietary information which may harm you or personal interests if repeated, copied, or otherwise transmitted and/or implemented by a third party.
Additional Legal Terms
1. If we get sued due to something you did:
You agree to indemnify, defend and hold harmless StrategyNook, its Life with Jan brand, it's successors and assigns from and against any and all claims, damages, losses, liabilities, lawsuits, costs and expenses (including attorneys’ fees at all tribunal levels) arising out of or related to any activity, work, or other thing done or permitted to be done by you where such liability arises from negligence on your part or the violation of this Agreement. This includes any liability arising from breach of confidentiality by any party.
2. Damages are limited under this Agreement.
To the maximum extent permitted by applicable law, company will not be liable to you for any indirect, special, incidental or consequential damages (including but not limited to damages for loss of business, loss of opportunity cost, loss of profits and the like), whether based on breach of contract, breach of warranty, tort (including negligence), or otherwise, even if company has been advised of the possibility of such damages, and even if a remedy set forth herein is found to have failed of its essential purpose. Damages, including attorney’s fees and costs, are limited to the amount paid under this agreement.
3. Results; Risk of Loss.
Results from the group program are greatly dependent upon individual decisions, abilities, and other factors outside Company’s control..
4. Life with Jan can end your participation in the program.
Company may determine, in its sole discretion and without requiring disclosure of the reason, that the relationship under this Agreement must terminate. In this circumstance, Company will provide a refund to you.
5. Florida law governs this Agreement and it will be enforced by either party in the State of Florida.
This Agreement will be governed by Florida, without regard to its conflicts of law principles. I understand and agree that I submit to the personal jurisdiction and venue of this state and agree that any legal proceeding commenced shall take place in Miami, Florida.
6. No Assignment; No oral waivers or modifications.
This Agreement may not be assigned to any other party. Its requirements may not be waived or modified except in writing signed by the Company.
7. Electronic Signatures and Other Documents.
You agree that joining this program this program makes this a valid and binding evidence of your assent to the terms of this Agreement.
Life with Jan maintains this website, any courses offered and other linked and related sites (the “Site”) for the use of its customers, vendors, students, and other Site users (“Users”) upon agreement to the following terms. Please read the terms carefully before using the Site. Use of this website indicates acceptance of these “Terms of Use” and forms a binding agreement between you and Life with Jan. If you do not agree to these terms, do not use this Site.
8. Use of Site
Life with Jan provides various materials, information, quizzes, tests, questions, articles, news and other information on this and related sites and in courses offered through this site (the “Materials”). Life with Jan. authorizes each User to view and download one copy of downloadable Materials. Materials may be downloaded and a maximum of one copy of the Materials may be printed provided that Users make no modifications to the Materials and you retain all copyright and other proprietary notices contained in the original Materials on any copies of the Materials. Users may not modify the Materials at this Site in any way or reproduce, share or distribute them. Users will keep all Materials confidential, and will not sell, auction, loan, rent, give away, describe, summarize, or otherwise reveal the Materials or their contents, to any other person or entity. Any breach of these Terms of Use automatically terminates your authorized use of the Site.
9. Trademark and Copyright
The Materials on this Site are copyrighted, and any unauthorized use of any Materials on this Site may violate copyright, trademark, and other laws.
